Illinois Public Act 103-0994 was signed into law by the Governor on August 9, 2024, amending the Illinois Power of Attorney Act to provide a statutory framework for when it would be reasonable for a third-party not recognize a financial Power of Attorney and when it would be unreasonable for a third-party to refuse to honor an otherwise properly executed Power of Attorney for Property. Our speaker panel will include a DuPage County Attorney involved in drafting this recent legislation and attorneys from CIBC Bank’s Legal Counsel to provide us with a better understanding on how financial Powers of Attorney are reviewed by bank counsel and insight on how these recent legislative changes will affect their practices in reviewing financial Powers of Attorney.

Ben Neiburger is the founder of Generation Law representing clients in the areas of elder law, estate planning, guardianship and probate. Ben is a member of the National Academy of Elder Law Attorneys and serves as a Co-Chair of the Illinois Chapter’s Legislative Committee.
Elizabeth Khalil is Deputy General Counsel for CIBC Bank USA and serves as its Chief Privacy Officer. Elizabeth is a former federal banking regulator serving at the Office of the Comptroller of the Currency (OCC) and Federal Deposit Insurance Corporation (FDIC).
Lauren Barney is the Associate General Counsel and Managing Director of legal support for CIBC Bank’s retail and consumer products. Lauren is a member of the CIBC Bank Legal Order Process Team responsible for responding to all legal process notices received by CIBC Bank.
Aaron White is a Senior Counsel and Managing Director for CIBC Bank’s Legal Team. Aaron is a former commercial litigation attorney representing private clients involved in bank litigation and probate disputes.
Eric Wilen is an attorney with the Naperville law firm of Brooks, Tarulis, and Tibble, LLC, and has practiced for over 25 years in estate planning. Eric regularly advises clients on the best practices for interacting with banks and financial institutions on matters involving powers of attorney, trusts and decedents’ accounts.
