2021 Legislation and Case Law Update

Neil Goltermann will provide information on new legislation filed with Illinois House and Senate since the new Session started. Please note the special start time of 4:00 p.m.

Important new legislation already filed includes Senate Bill No. 72 called the 
Electronic Wills and Remote Witnesses Act, Senate Bill No. 97 which proposes to amend the Illinois Notary Act by establishing and regulating electronic notarization and electronic notaries public, as well as provide that a paper or tangible copy of an electronic document that a notary public has certified to be a true and correct copy satisfies specified recording requirements. We will also discuss any new filings made by the time we meet. 

Neil will also discuss some details about recent case law, especially Baird v. Ogden Lincoln-Mercury, Inc., 2020 IL App (2d) 190409-U, leave to appeal denied, 159 N.E.3d 946 (2020), which was included in the February 3, 2020, legal update.

Financial planners, trust officers and accountants working with clients will want to learn about the new laws that are being proposed for wills, remote witnesses and remote notaries. Also, recent case law regarding spendthrift trusts and creditor access are important for everyone working with clients who have trusts so you (1) know the issues; (2) can identify potential problems; and (3) talk with your clients and their advisors about these issues.

Neil will start with a presentation on new legislation and cases, but we hope to make this an interactive discussion with questions and answers from the participants. With a lot of questions and discussion it is possible this session will run over an hour so we've scheduled through 5:30 pm.

Neil T. Goltermann concentrates his practice in estate planning, probate administration, business transactions and planning.  He works with and advises clients on planning for the lifetime management, protection and distribution of their assets, often including their companies.  He is on the DuPage Foundation Professional Advisory Committee, has served on the ISBA Trusts & Estates Council since 2014, and as the Chairperson of the DCBA Estate Planning Committee and Tax Law Committee.  This May, Neil will round out his service on the Board of the DuPage County Estate Planning Council, but will continue providing his popular Estate Planning Updates to Members of the Council.
